Kathmandu, Jan 23 (RSS) : Leaders of five-party ruling alliance have consulted legal experts regarding the legal provisions for the upcoming local level election.
The meeting between the ruling parties’ leaders and legal experts was held at the Prime Minister’s official residence in Baluwatar on Sunday. During the meeting, the legal experts suggested that the laws that are conflicting to the Constitution of Nepal should be amended.
Prime Minister Sher Bahadur Deuba’s legal expert Keshav Raj Joshi told the RSS that the experts had suggested for the amendment to the Local Level Election Act, 2073 since it was conflicting to the Constitution of Nepal.
The Article 225 of the Constitution of Nepal mentions the term of a Rural Assembly and of a Municipal Assembly, stating that the term will be five years for the date of election while adding that another Rural Assembly and Municipal Assembly shall be elected not later than six months of the expiration of such a term.
However, clause 3 of the Local Level Election Act states that such election shall be held prior to two months of the expiry of a Rural Assembly and of a Municipal Assembly.
In this regard, Article 1 of the Constitution states that constitution is the fundamental law of Nepal and any law inconsistent with this Constitution shall, to the extent of such inconsistency, be void.
As the major political parties are at loggerheads regarding the date of the local level elections for quite a while, today’s consultation is expected to offer a breakthrough.
Top leaders of Nepali Congress, CPN (Maoist Centre), CPN (Unified Socialist), Janata Samajwadi Party Nepal and Rastriya Janamorcha, Minister for Communications and Information Gyanendra Bahadur Karki, Minister for Law, Justice and Parliamentary Affairs Dilendra Prasad Badu, Minister for Federal Affairs and General Administration Rajendra Prasad Shrestha and Attorney General Khamba Bahadur Khati, among others were present in the meeting.
